By accessing and using BetterBlood (the "Service"), operated by BetterBlood Technologies LLC ("BetterBlood," "we," "us," or "our"), you ("User" or "you") accept and agree to be bound by these Terms of Service, Privacy Policy, and all legal disclosures contained herein (collectively, the "Agreement"). If you do not agree to all terms in this Agreement, you must not access or use the Service.
We reserve the right to modify this Agreement at any time. We will notify you of material changes by posting the updated Agreement on our website and updating the "Effective Date" above. Your continued use of the Service after such changes constitutes your acceptance of the revised Agreement.
You must be at least 18 years of age to use this Service. By creating an account, you represent and warrant that you are at least 18 years old. BetterBlood does not knowingly collect personal information from anyone under the age of 18. If we learn that we have collected personal information from a user under 18, we will promptly delete that information and terminate the associated account. If you believe a minor has provided us with personal information, please contact us at betterblood@protonmail.com.
BetterBlood is a health data tracking platform that allows you to upload laboratory results and receive AI-powered insights about your biomarkers over time. The Service organizes lab data by category, tracks trends, and provides AI-generated analysis to help you better understand your results.
IMPORTANT: PLEASE READ THIS SECTION CAREFULLY.
The insights, analysis, and information provided by BetterBlood are for informational and educational purposes only. They do not constitute medical advice, diagnosis, or treatment recommendations. BetterBlood is not a medical device, healthcare provider, or clinical laboratory.
BetterBlood has not been evaluated, cleared, or approved by the U.S. Food and Drug Administration (FDA). The Service is not intended to diagnose, treat, cure, or prevent any disease or medical condition. BetterBlood is not an FDA-regulated medical device and makes no claims regarding its ability to diagnose or treat any condition.
AI-generated insights may contain errors, omissions, or inaccuracies. The AI does not have access to your complete medical history and cannot account for factors not present in your uploaded lab results, including but not limited to medications, genetic conditions, lifestyle factors, or concurrent health conditions.
Always consult with a qualified healthcare professional before making any health-related decisions. Do not disregard professional medical advice or delay seeking treatment based on any information provided by BetterBlood. If you are experiencing a medical emergency, call 911 or your local emergency services immediately.
Your use of BetterBlood does not create a physician-patient relationship, a provider-patient relationship, or any other professional healthcare relationship between you and BetterBlood Technologies LLC.
IMPORTANT: BetterBlood is NOT a HIPAA-covered entity and does not sign Business Associate Agreements (BAAs). By uploading your health data, you acknowledge and agree that:
(a) Your data is NOT protected under the Health Insurance Portability and Accountability Act (HIPAA);
(b) You are voluntarily sharing your health information with a non-HIPAA-covered consumer technology service;
(c) While we implement commercially reasonable security measures as described in Section 9 of this Agreement, these measures do not constitute HIPAA compliance; and
(d) You assume the risk associated with sharing health data with a non-HIPAA-covered platform.
BetterBlood offers a free tier with limited usage (3 PDF uploads and 3 AI queries, lifetime limit) and Pro subscription plans (monthly and annual) for expanded access. Subscription fees are charged in advance through our payment processor, Stripe.
Refunds: Subscription fees are generally non-refundable except as required by applicable law. If you reside in a jurisdiction that grants a statutory right to a cooling-off period or refund, those rights are preserved.
Cancellation & Account Deletion: Canceling a Pro subscription will result in the permanent and immediate deletion of your account and all associated data, including all uploaded lab results, biomarker data, AI conversation history, and profile information. This action is irreversible. You will receive a confirmation prompt before deletion is processed. By canceling, you acknowledge and consent to the permanent deletion of all your data.
Payment Processing: All payments are processed by Stripe, Inc. BetterBlood does not directly store, process, or retain your credit card number or payment card details. Payment data is handled in accordance with Stripe's privacy policy and PCI-DSS standards. You can review Stripe's privacy policy at https://stripe.com/privacy.
BetterBlood uses third-party artificial intelligence services, specifically Anthropic's Claude API, to extract data from uploaded lab reports and generate health insights. By using the Service, you acknowledge and agree to the following:
(a) AI-generated outputs may contain errors, inaccuracies, hallucinations, or misleading information. You should independently verify any AI-generated insights before relying on them.
(b) AI insights are generated by third-party models developed and maintained by Anthropic, PBC. BetterBlood does not guarantee the accuracy, completeness, reliability, or suitability of any AI-generated content.
(c) The AI does not have access to your complete medical history, current medications, genetic information, or any health information beyond what you have directly uploaded or entered into the Service.
(d) AI outputs do not constitute medical advice, professional opinions, or clinical recommendations.
(e) BetterBlood is not responsible for any decisions, actions, or health outcomes resulting from your reliance on AI-generated content.
Training Data Disclosure: Your data is NOT used to train AI models. Anthropic's Claude API, as used by BetterBlood under its commercial API terms, does not use customer input or output data for model training purposes.
To provide the Service, certain data is transmitted to third-party service providers under strict confidentiality agreements and solely for the purpose of delivering the Service. The following data is shared:
The following data is transmitted to Anthropic's Claude API for the purpose of extracting lab data and generating AI insights:
Data Minimization: BetterBlood takes steps to minimize personally identifiable information transmitted to the AI service. For AI chat interactions, the AI receives only your demographic profile (age, sex, weight, height, activity level, diet) and biomarker values — your name, email address, account credentials, payment information, and IP address are never transmitted for chat queries. However, for PDF lab report extraction, your uploaded lab report is transmitted to the AI in its original form. Standard laboratory reports may contain personally identifiable information printed on the document by your lab provider, including your full name, date of birth, address, and ordering physician. BetterBlood does not modify or redact the contents of your PDF before transmitting it to the AI for data extraction. API inputs and outputs are automatically deleted within 30 days of receipt or generation and are not used for model training.
Anthropic's commercial API terms prohibit the use of customer data for training AI models. Under Anthropic's current commercial API data retention policy, API inputs and outputs are automatically deleted within 30 days of receipt or generation and are not used for model training. Retention may extend beyond 30 days only if content is flagged for usage policy violations or as required by law. Data transmitted to the API is processed in real-time and is subject to Anthropic's data retention and privacy policies, available at https://www.anthropic.com/privacy and Anthropic's commercial data retention page.
Your name, email address, and payment information are shared with Stripe for the purpose of processing subscription payments. BetterBlood does not store credit card numbers.
Your account data, uploaded lab results, biomarker data, and AI conversation history are stored using Supabase infrastructure. Data is encrypted in transit and at rest.
The Service is hosted on Vercel's platform. Vercel may process standard server access logs (IP addresses, request timestamps) as part of normal hosting operations.
We use Vercel Web Analytics and Vercel Speed Insights to collect anonymized, aggregated usage data about how the Service is accessed and how it performs. This data includes page views, visitor counts (not individually identifiable), referral sources, country of origin, device type, operating system, browser type, and performance metrics such as page load times and Core Web Vitals. Vercel Analytics does not use cookies, does not collect personal information, does not track individual users across sessions, and does not create user profiles. All analytics data is aggregated and anonymized. You can review Vercel's privacy policy at https://vercel.com/legal/privacy-policy.
We do not sell your personal information. We do not share your data with advertisers, data brokers, or any third party for marketing purposes. Data is shared only with the service providers listed above, solely for the purpose of operating the Service.
Information You Provide: Name, email address, password (hashed), demographic information (age, sex, weight, height, activity level, diet), uploaded laboratory report PDF files, and biomarker data extracted from those reports.
Information Generated by the Service: AI-generated insights, biomarker trend data, and chat conversation history.
Information Collected Automatically: We collect minimal technical data necessary to operate and improve the Service. This includes server access logs maintained by our hosting provider, and anonymized, aggregated analytics data collected via Vercel Web Analytics and Vercel Speed Insights (page views, visitor counts, referral sources, country, device type, browser, operating system, and performance metrics). Vercel Analytics does not use cookies, does not collect personally identifiable information, and does not track individual users. We do not use advertising pixels or third-party tracking scripts on the Service.
We use your information to: (a) provide and operate the Service; (b) process payments via Stripe; (c) generate AI-powered insights via the Claude API; (d) communicate with you regarding your account and the Service; (e) analyze aggregated, anonymized usage patterns and performance metrics to improve the Service; and (f) comply with legal obligations.
We implement commercially reasonable administrative, technical, and physical security measures to protect your data, including encryption of data in transit (TLS/SSL) and at rest, access controls, and secure authentication. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security. You upload data at your own risk.

We retain your health data, account information, and AI conversation history for as long as your account is active. Upon account deletion (whether initiated by you or triggered by subscription cancellation), all data associated with your account is permanently and immediately deleted from our active systems. Residual copies may remain in encrypted backups for a limited period consistent with our backup retention schedule, after which they are permanently destroyed.
Depending on your jurisdiction, you may have some or all of the following rights regarding your personal information:
Right to Access: You may request a copy of the personal information we hold about you.
Right to Correction: You may request that we correct inaccurate personal information.
Right to Deletion: You may request deletion of your personal information at any time by using the Delete Account button on your profile page or by contacting us at betterblood@protonmail.com. Upon receiving a verified deletion request, we will permanently delete all data associated with your account within 30 days.
Right to Know: You may request information about what personal data we have collected, the sources of that data, the purposes for which it is used, and the third parties with whom it has been shared.
Right to Opt Out of Sale: We do not sell your personal information. As such, there is no sale from which to opt out.
To exercise any of these rights, please contact us at betterblood@protonmail.com. We will respond to verified requests within 30 days, or within the timeframe required by applicable law, whichever is shorter.
The Service is operated from the United States. If you access the Service from outside the United States, please be aware that your data will be transferred to, stored, and processed in the United States. By using the Service, you consent to this transfer. We make no representation that the Service is appropriate or available for use in any particular jurisdiction outside the United States, and access from jurisdictions where the Service's content is illegal is prohibited.
If you are located in the European Economic Area (EEA), United Kingdom, or other jurisdiction with data protection laws that may differ from U.S. law, please note that we may not comply with all local data protection requirements (such as GDPR). By using the Service, you acknowledge this and consent to the processing of your data as described in this Agreement.
Certain U.S. states, including Washington, Connecticut, and Nevada, have enacted consumer health data privacy laws that apply to non-HIPAA entities handling health information. This section provides additional disclosures required under those laws.
We collect the following categories of consumer health data: laboratory test results (biomarker values, reference ranges, test dates); physical health indicators (blood panel results, metabolic markers, lipid panels, CBC results); and demographic health profile information (age, sex, weight, height, activity level, dietary information).
Consumer health data is collected solely for the purpose of providing you with the Service you have requested, including organizing your lab results, tracking biomarker trends over time, and generating AI-powered health insights.
Consumer health data is shared only with the service providers identified in Section 8 of this Agreement (Anthropic, Stripe, Supabase, Vercel), solely for the purpose of operating the Service. We do not sell consumer health data. We do not share consumer health data for advertising purposes.
By creating an account and checking the box agreeing to this Agreement, you provide affirmative consent to the collection, use, and sharing of your consumer health data as described herein, solely for the purpose of providing the Service. You may withdraw consent at any time by deleting your account.
If you reside in Washington, Connecticut, Nevada, California, Colorado, Virginia, or another jurisdiction with applicable consumer data protection laws, you may have additional rights, including the right to access, delete, or withdraw consent regarding your consumer health data. To exercise these rights, contact us at betterblood@protonmail.com. We will respond within the timeframe required by your jurisdiction's applicable law.
BetterBlood complies with the FTC Health Breach Notification Rule (16 CFR Part 318) and applicable state breach notification laws.
In the event of a breach of security involving your unsecured personally identifiable health information, we will:
(a) Notify affected individuals without unreasonable delay and in no case later than 60 days after discovery of the breach, via the email address associated with your account;
(b) Notify the Federal Trade Commission in accordance with the Health Breach Notification Rule;
(c) If the breach affects 500 or more individuals, notify prominent media outlets as required by law; and
(d) Comply with any additional notification requirements under applicable state law.
The notification will include: a description of what happened; the types of information involved; steps you can take to protect yourself; what BetterBlood is doing to investigate and mitigate the breach; and contact information for further inquiries.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
(a) THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
(b) BETTERBLOOD TECHNOLOGIES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
(c) IN NO EVENT SHALL BETTERBLOOD'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SERVICE EXCEED THE GREATER OF: (i) THE TOTAL AMOUNT YOU HAVE PAID TO BETTERBLOOD IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (ii) ONE HUNDRED U.S. DOLLARS ($100.00).
(d) BETTERBLOOD SHALL NOT BE LIABLE FOR ANY HEALTH OUTCOMES, MEDICAL DECISIONS, DIAGNOSES, TREATMENTS, OR ACTIONS TAKEN OR NOT TAKEN BASED ON INFORMATION PROVIDED BY THE SERVICE, INCLUDING AI-GENERATED INSIGHTS.
(e) SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES. IN SUCH JURISDICTIONS, THE ABOVE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless BetterBlood Technologies LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
(a) Your use of or access to the Service;
(b) Your violation of any term of this Agreement;
(c) Your violation of any applicable law or regulation;
(d) Any medical or health-related decision you make based on information provided by the Service;
(e) Any claim by a third party arising from your use of the Service; or
(f) Any data or content you upload to the Service, including any claim that such data infringes the rights of a third party.
This Agreement shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
You and BetterBlood agree that any dispute, claim, or controversy arising out of or relating to this Agreement or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. There is no judge or jury in arbitration, and court review of an arbitration award is limited.
YOU AND BETTERBLOOD AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.
Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the jurisdiction of such court.
You may opt out of this arbitration provision by sending written notice to betterblood@protonmail.com within 30 days of first agreeing to this Agreement. The notice must include your name, email address associated with your account, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in the state or federal courts located in the State of Maryland.
We may suspend or terminate your account at our sole discretion, without prior notice, for conduct that we determine violates this Agreement or is harmful to other users, us, or third parties, or for any other reason. Upon termination, your right to use the Service will immediately cease, and all data associated with your account will be permanently deleted.
You may terminate your account at any time by using the Delete Account button on your profile page or by contacting us at betterblood@protonmail.com.
The Service, including its design, features, code, algorithms, and content (excluding user-uploaded data), is the property of BetterBlood Technologies LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
You retain ownership of the lab data and health information you upload to the Service. By uploading data, you grant BetterBlood a limited, non-exclusive license to process your data solely for the purpose of providing the Service to you. This license terminates upon deletion of your account.
Severability: If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
Entire Agreement: This Agreement constitutes the entire agreement between you and BetterBlood Technologies LLC regarding the Service and supersedes all prior agreements and understandings.
Waiver: The failure of BetterBlood to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
Assignment: You may not assign or transfer this Agreement or your rights under it without our prior written consent. BetterBlood may assign this Agreement without restriction.
Force Majeure: BetterBlood shall not be liable for any failure or delay in performing its obligations under this Agreement due to circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, pandemic, government action, or failures of third-party service providers.

For data privacy requests, please include "Privacy Request" in the subject line. We will acknowledge receipt within 10 business days and provide a substantive response within 30 days or the timeframe required by applicable law.
BY CHECKING THE BOX AND CREATING AN ACCOUNT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY ALL TERMS, CONDITIONS, DISCLAIMERS, AND POLICIES CONTAINED IN THIS AGREEMENT. YOU FURTHER ACKNOWLEDGE THAT YOU ARE AT LEAST 18 YEARS OF AGE AND THAT YOU CONSENT TO THE COLLECTION, USE, AND SHARING OF YOUR HEALTH DATA AS DESCRIBED HEREIN.
